Smoke Free Law Public Act 188
Effective May 1, 2010

On December 10, 2009 the Michigan Legislature passed the Smoke-Free Air bill and this bill was signed into law by Governor Granholm on December 18, 2009.  Generally speaking, smoke free-laws are 'self enforcing' however, in the event of a violation, the Local Health Department will be responsible for enforcement of violations.  The Local Health Department has developed a graduated protocol regarding reported violations of the law.  Visit www.michigan.gov/smokefreelaw for detailed information or click on the links below to download Complaint Protocol Guidance for the Smoke-Free Law Public Act 188.

Reporting Violations of Public Act 188

If you observe or note a possible violation, please notify the
owner or manager of the establishment when feasible, and give them the opportunity to take the appropriate steps to resolve the situation before a formal complaint is filed. If the violation is not resolved, you can report the violation for further action.

You may complete the complaint form on the website: www.michigan.gov/smokefreelaw and submit it to the appropriate enforcement agency for the county in which the violation occurred.

The Enforcement Contact List, also provided on this website, lists the contact agency by county for filing complaints. Please review the Enforcement Contact List to ensure you are taking the appropriate steps and contacting the correct enforcement agency to report violations of the law. Please note, in some cases for worksites that are non-foodservice establishments, the enforcement agency is the Michigan Department of Community Health.
